1. Acceptance of Terms
By accessing or using MeritDeck ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms apply to all users, including recruiters and candidates.
2. Description of Service
MeritDeck is an AI-powered code assessment platform designed for technical recruiters. The Service enables recruiters to create role briefs, invite candidates to submit GitHub repositories, and receive AI-generated assessments of candidate code against role-specific criteria. Assessments are produced using artificial intelligence (Anthropic Claude) and provide structured, evidence-based evaluations to support recruitment decisions.
3. User Accounts
Recruiter Accounts
Recruiters register using email and password, authenticated via Supabase Auth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Candidate Access
Candidates access the Service via GitHub OAuth authorisation. No traditional account or password is created. Candidate sessions are managed through secure, signed cookies for the duration of the assessment process.
Account Security
You must notify us immediately of any unauthorised use of your account. MeritDeck is not liable for any loss arising from unauthorised access to your account where you have failed to maintain reasonable security of your credentials.
4. Recruiter Obligations
- You must have a legitimate recruitment purpose for using the Service. MeritDeck is not to be used for purposes unrelated to evaluating candidates for employment or contract roles.
- You are solely responsible for how you use assessment results in your hiring process. AI-generated assessments are advisory in nature and must not be treated as deterministic hiring decisions.
- You must not use the Service to discriminate against candidates on the basis of any protected characteristic, including but not limited to race, gender, age, disability, religion, or sexual orientation.
- You must exercise independent professional judgement when interpreting assessment results and making hiring decisions.
5. Candidate Rights
- Candidates submit their GitHub repositories voluntarily. No candidate is required to participate in a MeritDeck assessment.
- Repository access is temporary. GitHub access tokens are encrypted using AES-256-GCM during use and are permanently deleted after analysis is complete.
- Candidates receive feedback on their submission, including a summary of the assessment findings.
- Candidates may request deletion of their data by contacting us at the email address provided in Section 14. We will process deletion requests within 30 days.
6. Intellectual Property
- Candidate code remains the intellectual property of the candidate. MeritDeck does not claim ownership of any code submitted for assessment.
- Platform and methodology: MeritDeck owns all rights to the platform, including its assessment methodology, scoring algorithms, and user interface.
- Assessment reports are generated by MeritDeck and licensed to the recruiter who commissioned the assessment for internal recruitment use only. Reports may not be resold or publicly distributed.
7. AI-Generated Content
Assessments are generated by artificial intelligence (Anthropic Claude). By using the Service, you acknowledge and agree that:
- AI-generated results are probabilistic in nature and should not be treated as definitive evaluations of a candidate's ability.
- MeritDeck does not guarantee the accuracy, completeness, or reliability of any AI-generated analysis.
- Assessment results may vary and should be considered alongside other evaluation methods such as interviews and reference checks.
- Recruiters must exercise independent professional judgement and not rely solely on AI assessments for hiring decisions.
8. Acceptable Use
You agree not to:
- Attempt to game, manipulate, or artificially influence assessment outcomes.
- Submit code authored by someone other than the candidate being assessed.
- Reverse-engineer, decompile, or attempt to extract the scoring methodology or AI prompts used by the Service.
- Use automated tools, bots, or scripts to access the Service in bulk or in a manner that exceeds reasonable use.
- Use the Service for any purpose that violates applicable law or regulation.
9. Payment Terms
MeritDeck offers a free tier with limited functionality. Paid features are billed on a per-usage basis. By subscribing to a paid plan, you agree to the following:
- Fees are charged in accordance with the pricing displayed at the time of purchase.
- MeritDeck reserves the right to modify pricing with at least 30 days' written notice to affected users.
- Refunds are handled on a case-by-case basis and are at MeritDeck's sole discretion.
- Failure to pay outstanding fees may result in suspension or termination of your account.
10. Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
- MeritDeck is not liable for any hiring decisions made on the basis of AI-generated assessments.
- In no event shall MeritDeck's total liability to you exceed the total fees you have paid to MeritDeck in the twelve (12) months preceding the event giving rise to the claim.
- MeritDeck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity.
11. Termination
- Either party may terminate this agreement at any time. Recruiters may close their account through the platform settings. Candidates may request removal of their data.
- MeritDeck reserves the right to suspend or terminate accounts that violate these Terms, with or without notice.
- Upon account closure, your data will be deleted in accordance with our data retention policy. Assessment reports previously delivered to recruiters may be retained for up to 90 days before permanent deletion.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
MeritDeck reserves the right to update these Terms at any time. We will notify registered users of material changes via email at least 14 days before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
